By accessing this website we assume you accept these terms and conditions in full. Do not continue to use the Cake with Amber’s website if you do not accept all of the terms and conditions stated on this page.
The following terminology applies to these Terms and Conditions, Privacy Statement and Disclaimer Notice and any or all Agreements: “Client”, “You” and “Your” refers to you, the person accessing this website and accepting the Company’s terms and conditions. “The Company”, “Ourselves”, “We”, “Our” and “Us”, refers to our Company. “Party”, “Parties”, or “Us”, refers to both the Client and ourselves, or either the Client or ourselves. All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner, whether by formal meetings of a fixed duration, or any other means, for the express purpose of meeting the Client’s needs in respect of provision of the Company’s stated services/products, in accordance with and subject to, prevailing law of Australia. Any use of the above terminology or other words in the singular, plural, capitalisation and/or he/she or they, are taken as interchangeable and therefore as referring to same.
Services
Cake with Amber (formerly known as Commie’s Cupcakes) offers various in-person and internet-based services through the Website. Such services include but are not limited to:
Selling online and physical products and goods
Providing web based content
In-person and online classes
On-line chat groups and forums
and customisable online user profiles
Cake with Amber (formerly known as Commie’s Cupcakes) offers a segment of services at no-cost (Free Services) and others on a cost basis (Paid Services). Cake with Amber (formerly known as Commie’s Cupcakes) reserves the right to add or delete any of it’s Services at any time, including but not limited to, the right to change Free Services to a Paid Service, which may include a one of fee to access the content or a subscription based service.
Users who would like to utilise the Paid Services and certain Free Services (such as participation in the User Community) must establish a user profile on the Website. Cake with Amber (formerly known as Commie’s Cupcakes) may, at its option offer a number of other additional Services in the future through its Website. If additional Services are offered, Cake with Amber (formerly known as Commie’s Cupcakes) may in its sole discretion adopt additional rules, regulations, or terms of service concerning the additional Services.
The Services are offered for general informational and entertainment purposes only. Nothing in the services shall be considered advice. Site User should always conduct their own independent research into the recipes and techniques described in the Services and should not rely on the information presented in the Services as advice.

GENERAL TERMS AND CONDITIONS FOR IN-PERSON & ONLINE CLASSES:
Booking Classes
Classes must be completely paid for at time of booking. No Student is permitted to take a class that is not 100% paid for.
You will receive an email confirming your payment and reserving your spot for the class.
By booking a class, you agree to have your photo taken and used in advertising/marketing material and social media posts for Cake with Amber. Please advise prior to class if you prefer your photo not to be taken or used.
Payments for classes are final and non-refundable.
In the unlikely case of a class being cancelled by Cake with Amber, Student may take the class if/when it is rescheduled, use the payment as credit for another class or money will be refunded. Unfortunately, any additional expenditures lost by a cancelled class are not to be covered by Cake with Amber. (i.e. cost of flights)
For in-person classes, refreshments for each day of class are provided by Cake with Amber as well as lunch for full day classes. Please notify Cake with Amber of any allergies and/or dietary restrictions you may have at minimum two weeks prior to the start of class. You are welcome to bring your own lunch and/or snacks, however this will not be reimbursed by Cake wtih Amber.
Costs of travel, transportation, lodging and meals (other than lunches during class time) are Student’s responsibility.
Students must keep Cake with Amber updated on proper contact information in case of changes to any class (current phone number and email). We are only responsible for contacting you via the provided information and are not responsible for tracking Student down if contact information changes.
If booking for someone else, please ensure you tell us the Student’s full name. Provide their phone number and email address if you wish for them to receive contact information. If you don’t, you must provide your information and all notifications will be sent to you rather than the attendee.
All students must be 18 or older and are legally responsible for themselves and their actions while on Cake with Amber premises.
Anyone attending class less than 18 years of age must be accompanied by a legal guardian (over the age of 18) whom shall be completely be held responsible for said student while on the premise of Cake with Amber.
Cancelling
Classes may be cancelled due to of Acts of God (hurricanes, blizzards, etc.)
If a student misses a class or any part of a class for any reason, Cake with Amber is not responsible for refunding that student’s money for the class or any other costs.
A class may potentially be cancelled if there is not enough interest/seats sold. In this rare situation, Student gets the option of full credit that can be applied to another class or a refund for the cost of the class. Again, any other cost will not be reimbursed by Cake with Amber.
1:1 Cake Critique with Commie: The pre-questionnaire must be completed no less than one week prior to your 1:1 Cake Critique session. We reserve the right to reschedule or cancel your 1:1 Cake Critique if you do not submit your questionnaire in time.
Rights of Class Material
Unless otherwise stated, Cake with Amber and/or it’s licensors own the intellectual property rights for all material on the Cake with Amber website, online classes and in-person classes. All intellectual property rights are reserved. You may view and/or print pages from www.commiescupcakes.com for your own personal use subject to restrictions set in these terms and conditions.
You must not:
– Republish material from www.commiescupcakes.com or any material provided in the in-person or online classes
– Sell, rent or sub-license material from www.cakewithamber.com.au or any material provided in the in-person or online classes
– Reproduce, duplicate or copy material from www.cakewithamber.com.au or any material provided in the in-person or online classes
– Redistribute content from Cake with Amber, www.cakewithamber.com.au or any material provided in the in-person or online classes (unless content is specifically made for redistribution)Pictures of final products are allowed. Instructors will dictate if pictures and/or videos are acceptable to take throughout the class. Students are never to share/re-teach the specific details of what they learned in class (i.e. No step by step tutorials). Any student Cake with Amber suspects of re-teaching material may be denied access to future classes.
You are strictly prohibited from using the specific design you learn in our classes to advertise or run a similar class of your own. It is our intention to teach you skills, which will enable you to come up with your own designs, therefore offering the marketplace something novel. If you run classes or intend to run classes in the future, you may not use the specific lesson plans, class format, outlines, structures or photographs for your own classes or the promotion of your own classes.
Transportation of Cakes
Cake with Amber is in no way responsible for Student’s cake/cupcakes after you leave the Cake with Amber premise. Should anything happen to your cake during transportation that is your responsibility and Cake with Amber bears no accountability for Student’s cake once you have left the classroom. Cake with Amber will provide boxes for each student’s creation.
Property On Premise
Cake with Amber supplies what is required for the class. Students may bring personal tools if they wish, but are responsible for them.
Students are held accountable for the tools they are “borrowing” for the duration of their time at Cake with Amber. If a student loses or destroys property of Cake with Ambers, they may be held responsible for paying Commie’s Cupcakes the cost of repurchasing said item(s).
Student brings all personal property onto Cake with Amber premise at his or her own risk.
Should Student ask to keep a cake on the premise for any extended period of time, Cake with Amber accepts no responsibility for it. As this is a place of work and education, there is a possibility of damage and therefore Cake with Amber advises against you leaving cakes on the premises for extended periods. (Example: Student will be back in 4 months for another class and wants to leave their project at Commie’s Cupcakes until then).
Extra
Any injury sustained during a class is not Cake with Amber’s responsibility nor is Cake with Amber liable to pay for any costs related to an injury.
Students that need to tend to anything unrelated to class (i.e. a phone call) should excuse themselves from the classroom and do so quietly as to not interrupt class for the rest of the students and teacher.
Refunds are not available once payment has been made for any reason other than the class being cancelled by Cake with Amber/the Teacher. Please check carefully that you can make the dates before you book. This applies to any class booking, gift or any other method of booking. If you give your class to someone else, Commie’s Cupcakes must be informed of the new information.
Cake with Amber reserves the right to refuse its services to any student without reason.
Students should arrive at least 10 minutes BEFORE the start of the class. Class will not wait to start for those who are late. However, if you are running late, please notify Cake with Amber so we can wait a few minutes longer or be prepared to catch you up.
All class bookings are bound by these terms and conditions.
GENERAL TERMS AND CONDITIONS FOR ONLINE PRODUCTS:
Refund and Return Policy: Due to the nature of digital products, all sales are final and non refundable
Currency: All payments are in AUD unless otherwise specified.
Fees and Charges: Any additional fees or charges laid by third party payment gateways are the responsibility of the purchaser.
Limit of Liability: The advice and strategies contained herein may not be suitable for every situation. These classes, downloads and ebooks are sold with the understanding that the author (Amber Comadira-Smith) is not engaged in rendering legal, accounting or other professional services. If professional services are required, the services of a competent professional should be sought. Neither the company (Cake with Amber) or the author (Amber Comadira-Smith) shall be liable for damages arising herefrom.

Unused values will not be refunded or attributed to any transactions after the expiry date
Gift cards can be redeemed against all products on the Cake with Amber website
Gift cards cannot be redeemed for cash, returned for a refund, have their balances consolidated to a new voucher or be replaced after expiry and are not legal tender, account cards, credit or debit cards or securities
